Terms of Service
Last updated: October 13, 2026
1. Agreement to These Terms
These Terms of Service (the "Terms") govern your access to and use of the website at deltatechnologies.ai, the Delta hub and CRM, client portals, and the related software and services provided by Delta Technologies ("Delta," "we," "our," or "us") (together, the "Services").
By accessing or using the Services you agree to these Terms. If you use the Services on behalf of a company or other organization, you agree on its behalf and confirm you have authority to do so. If you do not agree, do not use the Services.
Where you and Delta have signed a separate written agreement, statement of work, or order form, that agreement governs the engagement it covers, and these Terms apply to anything it does not address.
2. The Services
Delta designs and builds AI-powered automation, software, and business operating systems, and provides access to hosted tools such as the Delta hub and CRM. We may change, improve, or discontinue features of the Services from time to time. Where a change materially reduces a paid Service, we will give you reasonable notice.
3. Accounts and Security
- You must provide accurate information and keep it up to date.
- You are responsible for activity under your account and for keeping your sign-in credentials, device tokens, and connected devices (such as print agents) secure.
- Tell us promptly at the address below if you suspect unauthorized access.
- We may suspend or revoke access that we reasonably believe is compromised, unauthorized, or in breach of these Terms.
4. Acceptable Use
You agree not to:
- Use the Services for anything unlawful, deceptive, or harmful;
- Access data, accounts, or workspaces you are not authorized to access;
- Probe, scan, or test the vulnerability of the Services, or bypass any security or access control;
- Interfere with or overload the Services, or use automated means to scrape them;
- Reverse engineer the Services except where the law expressly permits it;
- Use the Services to send unsolicited communications, or to place calls or messages that do not comply with applicable consent, recording, and telemarketing laws;
- Upload content you do not have the right to use, or that infringes anyone's rights.
5. Your Data
You keep all rights to the data and content you or your organization put into the Services ("Your Data"). You grant Delta the limited rights needed to host, process, and display Your Data to provide, secure, and support the Services. Each customer's data is kept separate from every other customer's.
You are responsible for having the necessary rights and consents for Your Data, including consent to record or transcribe calls where the law requires it. Our handling of personal information is described in our Privacy Policy.
6. AI Features
Some Services use artificial intelligence to draft, summarize, classify, or recommend. AI output can be incomplete or wrong. Review it before relying on it, and do not treat it as legal, financial, or other professional advice. You are responsible for the decisions you make and the messages you send using AI output.
7. Third-Party Services
The Services may connect to third-party products, such as Microsoft 365, telephony, payment, or data providers. Your use of those products is governed by their own terms, and Delta is not responsible for them.
8. Fees
Paid Services are billed as set out in your order form or statement of work. Unless that document says otherwise, fees are due on the stated terms and are non-refundable, and you are responsible for any applicable taxes.
9. Intellectual Property
Delta and its licensors own the Services, including the software, designs, templates, and brand, and all related intellectual property. These Terms do not transfer any of those rights to you. Ownership of custom work created for you is set out in your written agreement with Delta.
If you send us feedback or suggestions, we may use them without any obligation to you.
10. Confidentiality
Each party will protect the other's non-public business information that it receives through the Services with reasonable care, and use it only to perform or receive the Services, except as required by law.
11. Disclaimers
Except as expressly stated in a written agreement with Delta, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that any particular business result will be achieved.
12. Limitation of Liability
To the fullest extent permitted by law, Delta will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Delta's total liability arising out of or relating to the Services will not exceed the amounts you paid Delta for the Services in the twelve (12) months before the event giving rise to the claim.
13. Indemnity
You will defend and indemnify Delta against third-party claims arising from Your Data, your use of the Services in breach of these Terms, or your violation of law.
14. Suspension and Termination
You may stop using the Services at any time. We may suspend or end your access if you breach these Terms or if needed to protect the Services or other customers. Sections that by their nature should survive termination (including Your Data, Intellectual Property, Disclaimers, Limitation of Liability, and Indemnity) will survive.
15. Governing Law
These Terms are governed by the laws of the state in which Delta Technologies is organized, without regard to its conflict-of-law rules, unless a written agreement between you and Delta says otherwise.
16. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last updated" date, and for material changes we will give reasonable notice. Continuing to use the Services after the changes take effect means you accept them.
